What is the EB-2 Immigrant Visa?
The EB-2 Immigrant Visa, or EB-2 Green Card, is a second-preference employment-based immigrant visa that grants permanent resident status. It is available to foreign nationals with an advanced degree or equivalent qualifications. To qualify, you may need to demonstrate "exceptional ability" by showing significant expertise in your field or evidence of national or international recognition.

The EB-2 Immigrant Visa is divided into three categories:

EB-2A Requirements
If you're applying for an EB-2A immigrant visa under the Advanced Degree criteria, you need to have an advanced degree in your field or its foreign equivalent, plus 5 years of post-baccalaureate or progressive work experience in that field. You must also meet the specific requirements outlined in your labor certification.​

EB-2B Requirements
To qualify for an EB-2B Immigrant Visa based on Exceptional Ability, you must demonstrate a high level of skill in the sciences, arts, or business. "Exceptional ability" refers to having expertise significantly beyond what is commonly seen in these fields. You need to meet at least three of the following criteria to prove your exceptional ability:​​

Official academic records showing that you have a degree, diploma, certificate, or a similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability​

Letters documenting at least 10 years of full-time experience in your occupation

A license to practice your profession or certification for your profession/occupation

Evidence that you have commanded a salary or other remuneration for services that demonstrate your exceptional ability

Membership in a professional association(s)

Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations

Any other comparable evidence of eligibility
National Interest Waiver (NIW) Requirements
Individuals with exceptional ability who believe their work in the United States would significantly benefit the nation can apply for a national interest waiver to bypass the Labor Certification requirement.

To qualify for this waiver, the applicant must prove that waiving the job offer requirement is in the national interest. This requires providing evidence of an advanced degree or exceptional ability and meeting the following criteria for the National Interest Waiver:

It would be advantageous to the United States to waive the job offer and labor certification requirements.

Those applying for a national interest waiver must submit their labor certification directly to USCIS along with their self-petitioned Form I-140 (Petition for Alien Worker).
